NEW YORK COURT OF APPEALS AFFIRMS 13-HOUR COMPENSATION RULE FOR 24-HOUR HOME HEALTH CARE AIDE CASES

The New York Court of Appeals, the State’s highest court, just released its long-awaited decision in the “live-in” litigation that has dragged on for the last several years.  The Court upheld the NYS Department of Labor’s 13-hour rule for live-in aides.  This is a win for home health care providers that have for decades relied on the NYS DOL’s 13-hour rule to compensate their aides working 24 hour shifts.  We are currently reviewing this opinion and will issue a complete summary of the decision and its implications later today.
